We operate the Mums in Ashford Membership Club (the Club).
This document, together with the documents referred to within it, contains the terms and conditions on which we supply Mums in Ashford membership cards (Member Cards) and you become a member of the Club.

By ordering a Member Card you agree to be bound by these terms and conditions, so please read them carefully before ordering your Member Card.
The Contract between You and Us
By placing an order for a Member Card through our site, you warrant that you are at least 18 years old and capable of entering into binding contracts.
After placing an order for a Member Card, you will receive an email from us acknowledging receipt of your order. Your order constitutes an offer to us to become a member of the club, and only after we have confirmed our acceptance of your offer, by sending you an email that confirms your Member Card has been dispatched, or in the case of a trial membership (digital card), that your order has been completed, do you become a member of the Club. The contract between us is formed when we send you a dispatch confirmation for your Member Card, or an email that your trial membership order has been completed.
Your annual Club membership will last 1 year. The expiry date of your membership will show on your Member Card. We will send you an electronic reminder towards the end of your membership to advise you that your membership is coming to an end, and how to renew your membership should you wish to do so. Please inform us of any change to your email address during your membership of the Club.
Your trial Club membership will last 30 days from the date of the email we send you confirming that your order has been completed.
You have the right to cancel your initial registration of membership with us within 14 days of your purchase (the cooling off period). To cancel your membership, please email email@example.com or telephone 07922361876.
If you cancel your annual membership within the cooling off period, you will be entitled to a refund of your membership, less a £3.50 administration charge, being a pre-estimate of the loss we will suffer in the event of a cancellation. Refunds will be subject to the return of your Member Card and any other items we have despatched to you within 30 days of your cancellation. You will be responsible for the cost of returning your Member Card and other items in an unused condition.
If you cancel your trial membership within the cooling off period, you will be entitled to a refund of your membership, less a pro-rata amount for the period of cover used.
We do not provide refunds for any cancellations after the expiry of the cooling off period, subject to any other statutory rights you may have.
We aim to despatch your Member Card to you within 4 working days of our confirmation of your acceptance as a member of the Club. In any event, you will receive your Member Card within 30 days of our confirmation of your acceptance as a member of the Club, unless there are exceptional circumstances.
If you do not receive your Member Card, you must contact us within 30 days to request a replacement. If you do not contact us within the 30 days any replacement Member Card that is issued will be despatched at our administration fee of £3.50 and will be issued with the original expiry date.
Price and Payment
The price of your membership of the Club will be as quoted on our site from time to time.
Should you require a replacement Member Card, the cost will be £3.50.
Prices may change at any time, but will not affect orders in respect of which we have already sent an email confirmation.
Payment will be deducted when your order is placed.
On presentation of your Member Card, our affiliates will offer the discount they have advertised on our site at the time that you present your Member Card.
Discounts advertised on our site are only available to members that present a Member Card. Our Member Cards and memberships are strictly non transferable and can only be used by named members. The expiry date of each Member Card will be checked by our affiliates. Any attempted misuse of a Member Card may result in confiscation.
We will use reasonable efforts to update our site to show the particulars of our affiliates and the discounts they offer to our members. Our affiliates are entitled to withdraw from the club, or amend their terms and conditions of availability to you after you have become a member and we shall have no liability for any such withdrawals or changes in terms and conditions or availability.
Any printed marketing material you receive from us is intended as a guide to the affiliates that are participating at the time of publication of the material, and therefore may not include all of the participating affiliates at any one time.
Nothing in these terms and conditions excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
- any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.
Subject to the above:
- if we fail to comply with these terms and conditions, we shall only be liable for the membership fee;
- we will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:
- loss of income or revenue;
- loss of business;
- loss of profits; or
- loss of anticipated savings.
We accept no liability for any bad experiences at any of the participating affiliates. We will not become involved in any dispute between you and any affiliate.
We do not give warranty for any goods or services accessed through, or displayed on, our site.

When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirements that such communications be in writing. This condition does not affect your statutory rights.
All notices given by you to us must be given to the Director at email@example.com. We may give notice to you at either the email or postal address that you provide to us when ordering your Member Card.
We reserve the right to amend these terms and conditions at any time and will give you notice by posting the amended terms and conditions on our site. You will be subject to the terms and conditions in force at the time that you ordered a Member Card from us, unless any change to these terms and conditions is required by law or governmental authority.
Failure by us to enforce any of these terms and conditions will not prevent us from subsequently relying on, or enforcing them.
If any of the provisions of these terms and conditions are found to be invalid, unlawful or unenforceable to any extent by a court or competent authority, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
Third Party Rights
A person who is not a party to these terms and conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.
We reserve the right to amend these terms and conditions
These terms and conditions, and any document expressly referred to within, constitute the entire agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions. We both acknowledge that, in entering these terms and conditions, neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to within. Nothing in this clause limits or excludes any liability for fraud.
Law and Jurisdiction
This agreement shall be interpreted in accordance with English law and the English courts shall have exclusive jurisdiction.
